Terms of Sale

Your order is an offer to buy. AMAX AI may send an order confirmation email to acknowledge receipt of your order, but AMAX AI may not accept your order until we send you notice that the Product has shipped. AMAX AI may process payment for and ship parts of an order separately.AMAX AI reserves the right at any time, even after we send you a confirmation email, to decline or cancel your order or to limit order quantities for any reason, including errors or suspected fraud. AMAX AI generates an invoice upon completion of the server build. Our P.O.s are all Non Cancelable and Non returnable. Clients can change the specs of the order usually 7 days before shipping

Pricing and Availability

Prices and promotions are subject to change. AMAX AI  endeavors to communicate accurate pricing and product information, but errors may occur. In the unlikely event that an error impacts your order, or a Product ordered is no longer available, we will either contact you for instructions or cancel your order.

Taxes and Fees

Unless you provide Kognetick with a valid and correct tax exemption certificate, you are responsible for sales and other taxes associated with your order.


Product title passes to you when the Product ships. You are responsible for inspecting the package(s) upon delivery and must note any visible damage on the proof of delivery or delivery receipt the shipping carrier asks you to sign. AMAX AI is not responsible for any visible shipping damages not noted on the delivery receipt.

Purchases may not be resold or exported.

Unless you have a reseller agreement with AMAX AI, your purchase is for your own use, not for resale, export, re-export or transfer. Your purchase is subject to and you are responsible for compliance with the export control and economic sanctions laws of the United States and other applicable jurisdictions (“Export Laws”). Your purchase may not be sold, leased, or transferred to restricted countries, restricted end users, or for restricted end uses according to the Export Laws

Governing Law

These terms and any dispute between you and AMAX AI will be governed by the laws of the state of California.

Dispute Resolution and Binding Arbitration. You and AMAX AI agree to resolve any disputes between us exclusively and finally by binding arbitration on an individual basis, which means you and AMAX AI waive any right to litigate disutes in a court or before a jury, or as part of a class action, a representative action, a consolidated action, or in a private attorney general capacity.


AMAX AI offers a one year limited warranty on materials and workmanship from the original date of invoice. We also offer 3 year hardware warranty coverage as an option. The warranty does not apply to any Products that are damaged due to the misuse, abuse, negligence, alteration, unauthorized repair or installation or returned to AMAX AI physically damaged.

Out of warranty service

AMAX AI can repair Product under our Out of Warranty Service.   You will be responsible for 2 way freight to ship the Product to AMAX AI and back to you.  You will also be responsible for the cost of parts needed to repair the Product that are out of warranty period. AMAX AI will provide a price quote to you for your review and approval before any work is performed. If you decide not to have the Product repaired or there is No Problem Found with the Product, you will incur a $360.00 diagnostic fee.

U.S. Returns and Refunds policy

(applies only to purchases made directly from AMAX AI)

You may return most products you purchase directly from AMAX AI within 30 days from invoice based on the conditions below. For all purchases not made directly from AMAX AI, please check the return policy of the location from which you purchased your product.

Unless you have a separate agreement with AMAX AI , or except as provided below, all hardware may be returned within 30 days from the date on the packing slip or invoice for repair or replacement if the product if deemed defective. You will be responsible for shipping and handling and risk of loss or damage during transit to AMAX AI. Any product returned to AMAX AI without prior authorization from AMAX AI will be considered an unauthorized return, and we will not be able to accept this return nor can we ship the product back to you.

Promotional Items

If you return a purchased item that qualified you for a discount, promotional item or promotional card, AMAX AI may deduct the value of the discounted, promotional item from any refund you receive for the return of the purchased item.

Shipping and handling

Within the first 30 days of warranty coverage in the US., the client pays inbound freight and AMAX AI pays outbound freight via Ground method.  Client can provide their own freight account # if client wishes to expedite freight delivery. INt’l clients are responsible for 2-way freight.  If product arrives to client DOA, please contact technical support immediately to resolve. If technical support cannot correct the issue, AMAX AI will pay 2-way freight to diagnose the system at AMAX AI site.

Restocking Fees: Unless the product is defective or the return is a direct result of an AMAX AI error, AMAX AI may charge a restocking fee of up to 15% of the purchase price paid, plus any applicable sales tax.

Exceptions to AMAX AI 30-Day Return Period:

  • Software may not be returned for a refund at any time.
  • Product that is damaged due to misuse, abuse or negligence, alteration, unauthorized repair or installation is considered out of warranty.
  • Product that arrives back to AMAX AI physically damaged is out of warranty.

How to Return a Product:

Before returning a product, you MUST first contact AMAX AI customer service at customer_service@amaxai.com and obtain a Return Material Authorization (RMA) number before the end of the applicable return period.  AMAX AI will not accept returns without a valid RMA number. NOTE: You must ship the product to AMAX AI within 5 days of the date that customer service department issues the Return Material Authorization number and MUST follow these steps:

  • Ship back all products you are seeking to return to AMAX AI and for which you received a RMA number.
  • Return the products securely packaged in their original packaging, in as-new condition, along with any media, documentation and any other items that were included in your original shipment.
  • Ship the products at your expense, and insure the shipment or accept the risk of loss or damage during shipment.
  • Upon receipt of your return, AMAX AI reserves the option to repair or replace the Product with new, refurbished, or similar versions of the same components.

Note: Before you return the product to AMAX AI, make sure to back up any data on the hard drive(s) and on any other storage device in the product. Remove any and all confidential, proprietary and personal information as well as removable media such as flash drives, CDs and PC Cards. AMAX AI is not responsible for any confidential, proprietary or personal information; lost or corrupted data; or damaged or lost removable media that may be included with your return.

Upon receipt of your authorized return, AMAX AI will issue a credit or a refund of the purchase price paid, less shipping and handling, and any applicable restocking fees subject to this policy. Liquid-cooled workstations and servers, orders with custom components are NCNR (non-cancelable, non-returnable). Orders over $7000 and orders that have been financed are not eligible for return.
